Kenya Stakeholders speak on Kenyan football, call for Namwamba intervention

Football stakeholders in Kenya have released 10 key points they feel will help bring sanity to the number one sport in the country including the intervention of Sports CS Ababu Namwamba.

In a statement obtained by Africa Top Sports, signed by Secretary Wilfred Marori, the stakeholders said: “We, the football stakeholders in Kenya, express our deep concern and dissatisfaction with the current state of football administration in our country, overseen by the Football Kenya Federation (FKF). We hereby give direction to the sector as follows:

  1. The immediate recognition and acceptance of the removal of FKF NEC by the Ministry of Sports and Arts from office, as mandated by the law, and with no challenge to this decision. The High Court has affirmed the removal of FKF NEC from office. There is no gazette notice reinstating FKF NEC to the office.
  2. Nick Mwendwa is conducting FKF business illegally and must cease and desist immediately or risk facing contempt charges.
  3. The Court of Arbitration for Sport (CAS) has confirmed the lawful removal of the FKF NEC from office, as evidenced in the ruling over the Harambee Starlets case, which also confirmed that the FKF CEO had no mandate to act on behalf of the federation.
  4. FIFA currently does not recognize the leadership of FKF, leading to Kenya’s exclusion from FIFA congress meetings.
  5. FKF is registered under the Sports Act of 2013 and FKF received an interim certificate with certain conditions that needed to be adhered to, but these conditions were not met.
  6. The Registrar is obligated to call for an election and enforce the sports act 2013.
  7. The Government and FIFA must immediately constitute an electoral board to oversee the elections that must be held not later than October 2023.
  8. FKF’s constitution should be aligned with the Sports Act of 2013, and the electoral code should be aligned with the Sports Registrar Regulation Act of 2016.
  9. Government officials and privates sector stakeholders should take notice of illegalities by individual perpetrators claiming to be FKF NEC members and should cease any association immediately, as they are in office illegally, and that all decisions made by FKF NEC from November 11th, 2021, to date should be deemed null and void.
  10. We call on the Cabinet Secretary for Sports, Hon. Ababu Namwamba, to honor court rulings and uphold the Kenyan constitution.”
